Uncontested Divorces
An uncontested divorce is one in which you and your spouse have agreed to resolve all marital issues. This means that you and your spouse have reached an agreement regarding a division of property and debt, spousal support or alimony, custody and child support. Divorce procedures vary from state to state and in Missouri, uncontested divorce law cases can be handled by the St. Louis Cantor Law Firm (serving St. Charles, the City of St. Louis and St. Louis County among other areas). To obtain an uncontested divorce either you or your spouse must reside in Missouri for six months prior to filing a petition for a divorce. Missouri is a no-fault state, which means you do not have to prove adultery or cruelty to receive a divorce. An acceptable ground to divorce is stating in your petition that the marriage is irretrievably broken and cannot be preserved. Each party is required to make a full financial disclosure to the other (i.e., income, expenses, assets and debts). Each spouse will need to prepare a statement of property and debt and a statement of income and expenses. If there are any minor children a Parenting Plan is required as well. A Parenting Plan will include the type of custody, visitation schedule and child support you are agreeing to.
These documents must be filed with the court. It is customary for your attorney to prepare a Marital Settlement Agreement. A Marital Settlement Agreement lays out the terms of your divorce. It will include how all property and debt will be divided as well as custody, the terms of the parenting plan.
